THESE TERMS OF USE ARE ALSO KNOWN AS YOUR CARD-HOLDER'S "AGREEMENT".

1. This Agreement constitutes the agreement outlining the terms and conditions under which the Applebee's FAN CLUB LOYALTY CARD (the "Card") has been issued to you. The Card is issued by Apple Sauce, Inc. In this Agreement, "You" means the person who has received the Card and is authorized to use the Card as provided for in this Agreement (also known as a "Cardholder"). "We", "Us" and "Our" refer to Apple Sauce, Inc., our successors, affiliates and Assignees. By accepting and using, or authorizing any other person to use, your Card, you hereby agree to be bound by the terms of use contained in this Agreement and are responsible for all transactions involving the Card.
2. Your Card may be used to make and track purchases only from those Apple Sauce, Inc. restaurants listed on the web site and may be updated from time to time, but currently are located only at Applebee's located in Dade or Broward County, Florida. The Card may not be refunded or exchanged for cash or credit.

CARD RULES AND THE WEBSITE

1. You will not receive any interest on your Card balance. The funds on your Card are not insured by the Federal Deposit Insurance Corporation or any other federal or state agency.
2. To check the available balance on your Card, review recent transactions or obtain other customer service at no charge, you may visit www.ourapplefans.com.
3. We are not responsible for temporary interruptions in service due to maintenance, website changes or failures. We will not bear liability for any damage or interruptions caused by computer viruses that may affect your computer or other equipment

VALID FOR A LIMITED TIME

1. The program may continue or discontinue without notice. Points are valid as long as the program is honored by individual Apple Sauce, Inc. Applebee’s® locations.
2. Some of the Services may be subject to additional posted conditions and your use of those Services is subject to those conditions. In the event of an inconsistency between these Terms and any additional posted conditions, the provisions of the additional conditions will control.
3. The use of Apple Sauce, Inc., Applebee's, and Applebee's FAN trademarks, service marks, and logos is prohibited without our written consent and we will strictly exercise and enforce our rights to them to the full extent of the law.
4. The information you provide is private and will not be sold or transferred. Your information including your email address will be used for internal marketing purposes to notify you of specials and promotions from time to time, and until further notice.
5. You agree not to copy, modify, rent, lease, loan, sell, assign, distribute, reverse engineer, grant a security interest in, or otherwise transfer any right to the technology or software underlying our Website or the Services.
